Minnesotans arrested for driving while impaired (DWI) will now be required to have an alcohol ignition interlock installed on their vehicle to reduce the revocation period. This is an additional costly consequence for DWI offenders. Its greatest negative impact is on first offenders who, prior to the new legislation, were not require to have an alcohol interlock installed to drive on a limited license. The ignition interlock program does have some positive characteristics, however, in that it allows people with multiple violations the opportunity to regain their driving privileges sooner by participating in the Minnesota Ignition Interlock Program.
Specifically, the program allows eligible DWI offenders the opportunity to have ignition interlock devices installed in their vehicles to ensure they are driving without consuming alcohol.
A. THE IGNITION INTERLOCK DEVICE.
The ignition interlock device itself is the approximate size of a hand-held calculator that is cabled to your vehicle. The device requires any driver of the vehicle to provide a breath sample before starting the ignition. If the device detects a certain alcohol-concentration level after the driver blows into its tube, the vehicle will not start. The device also calls for retests after the initial test. If you fail a retest, the failure is recorded, however, the vehicle is not stopped if the engine has been started.
The alcohol interlock testing apparatus is not infallible. This may lead to challenges to the accuracy of test results. For example, some mouthwash brands and sprays have up to 30 percent alcohol. Use of such products may result in a positive test on an interlock device.
Additionally, certain foods may cause the ignition interlock device to fail including certain candies and certain bread products where sugar and active yeast can combine to create an alcohol reading. Alcohol-filled chocolate s will also increase the likelihood of a fail reading.
Finally, many perfumes and colognes contain alcohol. Testing companies claim that their devices can discern between alcohol content in ambient air from that contained in a breath sample, however, reliable evidence would have to be presented in that regard when a failure is challenged.
B. PARTICIPATING IN IGNITION INTERLOCK
The steps that are necessary to participate in the Minnesota Alcohol Ignition Interlock Program will depend on the level of your DWI offense. Additionally, the type of driver's license you receive by participating in the program will depend on the number of offenses.
·Restricted License. With a restricted license, you may drive anywhere as long as the device is installed in your vehicle. After a license cancellation, a person with a restricted license will have a notation on their driver's license stating "ignition interlock required" — meaning a person must drive a vehicle with an ignition interlock installed.
·Limited License. With a limited license, you will be allowed to drive to work, school, treatment and support programs such as Alcoholics Anonymous, to court and probation appointments.
To participate, the following steps must be taken:
·the vehicle on which the ignition interlock is installed must be validly insured;
·the driver must pass the DWI driver's license exam
·the driver must fill out an application for a new driver's license;
·the driver must pay $680 reinstatement fee and keep receipt;
·the driver must review, sign and date the Minnesota Ignition Interlock Program Participation Agreement. (This is the Agreement spelling out the terms of the program. Any violation would result in license cancellation or revocation.)
After necessary documents are sent to the Department of Public Safety to participate in the ignition interlock program, the driver must call an approved ignition interlock vendor to schedule an installation appointment. The driver must also attend a necessary training session along with anyone else who will be driving the vehicle. The vehicle must be brought in monthly for maintenance visits and to check the computerized system for compliance.
C. COSTS OF PROGRAM
DWI is already one of the most expensiveoffenses in Minnesota Statutes. In addition to fines ranging from $300 to thousands of dollars, a driver must also pay $680 as a license reinstatement fee, plus surcharges. The cost of the installation and maintenance for the Alcohol Ignition Interlock Program is additional to those expenses. Generally, there is an application fee, the cost of installation ranges from $90 to $100 and the maintenance fees amount to $60 to $125 pe r month.
D. IGNITION INTERLOCK: Level of Offense
First DWI Offense - Restricted License.
After a first offense, the individual driver may not drive for 15 days once the revocation takes effect. Generally, the revocation occurs after a seven day temporary license expires.
The ignition interlock is installed for one year with a restricted license. The person gets full driving privileges with the restriction that they must drive a vehicle with an ignition interlock installed.
Second and Third DWI Offense - Restricted License.
After a second or third offense, the driver may not drive for 30 days after the license revocation occurs. The ignition interlock system is installed for a minimum time frame of a year and a half with a restricted license. The driver must have no failed tests recorded on device.
First Cancellation as Inimical to Public Safety - Limited/Restricted License
I f a driver receives their first cancellation as inimical to public safety, he/she may no drive at all for 30 days. The ignition interlock is installed for two years. During the first year, the driver will have a limited license allowing the person to drive to/from work, treatment, or support group. In the second year, the person receives a restricted license.

Any failed breath test will be recorded on the interlock device. The failure will be downloaded at the monthly maintenance appointment. Information that is recorded includes the following:
·instances where the driver had an alcohol concentration of 0.02 or higher;
·instances where the driver tried to start the vehicle without taking the test;
·instances where the driver failed the rolling retest or refused to take it;
·any attempt to bypass or tamper with the device;
·Th e number of times the vehicle was started and stopped;
·The distance traveled by the vehicle.
A report is generated by the vendor that installed the device and is transmitted monthly to your probation officer or a representative from DVS to verify compliance.
If a driver has three non-compliant tests between service appointments, the device will notify the user of a pending "lock out" that will take effect after 72 hours. The user will need to call the interlock vendor for a code within 48 hours of this notice, key this code into the handset and follow up with a service appointment with the interlock installation service center. The user will be required to pay the $50 "lock out" fee. The driver is responsible for ALL TESTS. This would include any tests by others who may seek to drive the vehicle. If you cannot afford a car or are having trouble qualifying for financing, you know the frustration. Being without a car is more of an inconvenience than many people think, and it can be hard to get sympathy from people we know who already have cars. "Why don't you just save up until you can afford one?" or "Why not just take the bus?" might be what you are hearing from others.
Well, those people apparently do not remember what it is like to try to get by these days without an automobi le. The reasons for owning a car are too many to count. Some of the reasons include: getting to and from work, going grocery shopping, visiting friends, and having a vehicle on hand in case of a medical or other emergency. Without a car, all of these things are made more difficult - if not impossible.
The most logical way to get that oh-so-necessary car is to take out a loan. 1. Learn Your FICO Score
The single most important factor that influences ho w good of an interest rate you qualify for - and even whether you qualify for a loan in the first place - is your FICO (or credit) score. Your score is calculated independently by at least three different major credit-reporting agencies: Equifax, Experian and TransUnion. Each agency uses the same formula to calculate your credit score. However, given that they each have access to slightly different information about you, the scores vary. Make sure to learn all three of your scores.
2. Compare Offers From Multiple Lenders
Many people seeking a car loan make the mistake of just contacting one bank or credit union and going forward with them. This is a mistake because, as with anything else in life, more choices is better than fewer choices. By contacting multiple lenders, you have a much better chance of receiving multiple loan offers at different interest rates. Bottom line: competition among lenders is good for you!
3. Consider Your Local Credit Union Or Bank
Before walking into an auto dealership and asking them for a loan, stop by your local bank or credit union first and talk to their loan officer. Many credit unions, in particular, have set up special auto loan programs for their members. Having a potential loan deal in hand before visiting the dealership is a great confidence builder, and it gives you more leverage when negotiating with the dealer.
4. Do Not Accept The First Offer You Get
When applying for loans from multiple lenders, be careful not to just accept the first offer that you receive. Even if you think you have found the best lender for you, it is likely that their first offer is not their best offer. Remember, their goal is to make money, so they are working with a range of possible deals for you. Be bold and ask if they can do better. What do you have to lose?
5. Buy A Car Within Your Means
This last tip may deserve to be at the top of list: make sure you are buying a new or used car that is within your financial means to afford. It is always tempting to buy a car that you cannot quite afford. However, every $500 or $1,000 you can shave off of the purchase price will mean significant savings for you in terms of monthly payments and overall cost of the loan.

The biggest challenge restauranteurs face is what I like to refer to as the "Double Whammy". In today's economy, people are not only eating out less but are eating less when they do elect to dine out. People are skipping appetizers, skipping dessert, and splitting meals. How is a restaurant owner to survive under these circumstances?
This solution actually begins at the end - the end of the meal that is. One of my biggest pet peeves in life is after having enjoyed a great meal; I am asked if I want dessert. Worse yet, when the server says "you are probably all too full for dessert, huh"? This is tantamount to a sales person saying "you wouldn't want to buy anything from me today, would you"? What this says to me is that the server is more interested in turning the table than on increasing the size of his or her gratuity through increased sales.
What if I told you that you could increase your average check by $10 - $20 by merely selling on e extra cup of coffee? Would you be interested? I would bet that you would.
Here is how it works:
At the end of the meal, the server is trained to approach the table with a smile and an enthusiastic "Can I interest you in a great tasting cup of our freshly roasted coffee"? His or her head is nodding at the same time.
Experience tells me that if someone at the table orders a cup of coffee, at least one other will follow suit. It almost always happens that way. If you have enjoyed a nice dinner, and you order a cup of coffee, dessert is sure to follow. Let's say each cup of coffee sells between $2.50 and $3.00.
We have all seen the "Can I bring one dessert and several forks?" approach. Here is my favorite:
The server approaches the table with a small 5" plate with a small piece of three or four desserts on the plate. Each dessert has a frill pick in it. The tag line is "Here are a couple of ou r great tasting desserts. Now which one can I bring you?" The server is smiling and nodding the entire conversation. If the group has ordered a couple of cups of coffee, at least 1-2 desserts will be sold. Desserts easily sell between $4 and $6.
If the server is really good, there is an opportunity for an after dinner drink. After dinner drinks can easily sell for $8 - $10.
Ok, let's do the math. 2 cups of coffee = $5.00. Two desserts = $10. One after dinner drink = $9. Conservatively speaking, we have just increased the average check by $24 by just selling one more cup of coffee. If you were just able to accomplish this at 10 tables per night, revenues could increase by $240 per night, $1680 per week, $6,720 per month, and so on.
Our job is not done, however. The real work to be done is in the training of the wait staff. They honestly do not care about average check or selling more unless they can see a direct correlation to their pocket book. On that extra $24 check, they would receive an additional $4.80 in gratuity if the rate were 20%. At 10 tables per night, they would take home an additional $48 and $240 per week if they worked a 5 day shift. That's a lot of cash to bring in for just selling one cup of coffee.
To get this rolling, I recommend starting with an incentive for the wait staff. Hit your foodservice distributor up for a case of coffee or dessert to kick this off to cover costs. If the server sells one cup of coffee, they get 25 cents. If they sell one dessert, they get 25 cents. If they sell both, they get $1.00. Give prizes for the top performers. I don't think you'll have a problem with coffee sales with a promotion like this.
There is one other thing, however. Enjoy the additional profitability of your restaurant!

Once you know what you owe, begin looking at the ways you spend your money. Are you needlessly spending money everyday on useless things? This money can be going to pay off your debt! Start tracking your expenses and see which expenses you can rule out.
If you have credit card debt, you want to learn how your credit cards operate. How much are you getting charged in interest? Are you only paying your minimum payments? If you are only paying the minimum payments on your credit cards, this may very well mean you are not paying off the principle balance. In fact, most likely your principle balance will only decrease slightly and the rest of your minimum payment is going to pay interest rates. Make sure you are paying more than your minimum monthly payment in order to get out of debt quicker.
Do you have high interest rates on your credit cards? If so, call your credit card company and ask for a lower rate. Tell them you've received an offer in the mail from a particular bank that is offering you a lower rate. Ask that they give you a competitive offer in order to stay in business with them.
Make sure your credit cards do not charge you an annual fee. If you are a good customer, who makes their payments regularly and on time, call and ask to have this fee waived. If you part of special reward programs, the company may not waive this fee. However, if you are an ordinary customer with no rewards program, you may very well have this fee waived just by asking.
Avoid late fees. Late fees are a way many credit card increase their revenue. If you are expecting to be late on a payment, call and ask for a grace period. Ask that your phone conversation is documented. A sk for the sales representative's name and badge ID so that you can document the conversation as well. If you are already late on your payment, but have ordinarily been a good customer call and ask for the fee to be waived.
If you want to finance the life you crave without the burden of debt, it may take time, but it is possible. All you have to do is start! Start being honest with yourself. Start cutting your costs, and understand the debt that you already owe.
Today's economy is abundant with mortgage scams. Thieves are taking advantage of homeowners' desperation, many with offers that sound too good to be true. These scams are generally under the guise of "mortgage rescue" programs. You must be very careful and not let your house get tied up in one of these scams. Equity stripping is one of the scams. If a homeowner is facing a fo reclosure, a lender claims that they are rescuing the homeowner by purchasing the property and allowing the homeowner to stay in the property as a renter. In this scam, it is not always clear to the homeowner that they are turning over ownership of their house to the lender until the transaction is complete.
Another mortgage scam occurs when illegitimate lenders or credit counseling services pretend to assist in mortgage refinancing. These companies also call themselves loan modification companies. Many times these companies collect all your personal information and request you send a check to process the paperwork for a great new rate. The check is cashed, and the company or person disappears, but your mortgage rate remains the same.

Consumers Can Dispute Credit Reports with Creditors
The FTC recently te stified before Congress and stated that starting July 1st, 2010, consumers will have a right to dispute credit reports directly with the creditor, also called a "furnisher" because they furnish the data to the credit reporting companies. Two examples of a creditor are a credit card company or mortgage lender.
In the past, the FTC only required consumer credit reporting companies (Experian, Equifax and TransUnion) to handle credit report disputes (they would in turn communicate with the furnisher directly).
This is a substantial change, at least on paper, to one of the biggest areas of consumer credit problems and identity theft. How it will work in practice, and whether it will improve things for consumers, remains to be seen.
Javelin 2010 Identity Fraud Survey Report
Javelin released their 2010 Identity Fraud Survey Report. It's a mixture of positive and negative news. Identity fraud still grew by 12% in 2009, although less quickly th an in 2008 (22%). However, cases are also getting reported and resolved more quickly. Javelin reports 11.1 million U.S. adults were victims in 2009 and the total fraud amount increased by 12.5 % to $54 billion. Average fraud resolution time dropped 30% to 21 hours, and nearly half of the victims file police reports, resulting in double the reported arrests, triple the prosecutions, and double the percentage of convictions in 2009.
Lastly, be aware that increasingly, identity theft starts with information that the thief finds online in public directories like white page listings. Be sure to get rid of these listings yourself, or choose an identity theft service that removes them for you. Here is how it works: Using these directories such as CitizensInfo.com or PhoneNumbers4.me, a thief looks up your info. They then have enough information to pose as you and open new accounts. It is scary to see how much info there is about each of us. Be aware and check yourself out .
